The only difference is that by taking "pre-orders" directly there's not even the thin film of legal protection from kickstarter: he literally can just take the money and run.
To be fair, EvilDragon, by also taking direct pre-orders, is in the same boat, but he's proven himself to be an outstanding captain who has navigated rocky shores before. These guys, you point out the giant iceberg and they're just "that's still several km away, we'll deal with it when we get there"."We have a major investor backing us so even if we hit that iceberg we won't sink".
