was gbax.com private sellers? Quality is different from actually working...i wouldnt complain if the button was made of tissue paper (probbly would :p ) but it doesnt work..

I think i am a reasonable person, expecting a $500 gadget to work as advertised..

and apparently i am entitled to a full refund, maybe ill get myself one of those cheapass no win no fee lawyers..

Will you please now offer me my refund or at least pay for shipment costs..i can be very stubborn (wont let this go).

I hope people will take this on board before buying from you especially now that you are selling MORE products again soon. I guess ill try to get more people's opionions from irc etc
 
Well, problem is:

Yes, GBAX offered a 1 year guarantee, as they did with ALL their products.
That was before Sony came in.

Sony sued them (as they did with all importers) and won the case.
All the shops who sold imported PSPs were forbidden by law to deal with anything which had to do with the PSP anymore.
They were even forbidden to talk about that, which is why GBAX can't respond much more to you.

Now we have quite a bit of a problem:

1. Through UK law, they have to guarantee their warranty.
2. UK law forbid them to handle anything which have to to with the PSP.

It's quite a hazzle - how can they deal with that?
What happens if you'd sue GBAX? They were forbidden by law to handle this.

This is a pretty bad situation... for GBAX (and all importers) and much more for the buyers...

I'd try to ask Sony to exchange it. Here in Germany, most of the manufacturers deal with warranty problems and replace the stuff if it's a common problem for free.
Maybe you need to phone Sony a few times, as not everybody will agree to do it for free for you. You may need to convince them.
 
maybe your right ill phone sony again now, but they already said when i asked them that they should deal with the issuse themselves.

and they can deal with it, like any decent company would do by refunding me the full price/ paying for repairs.

Well, as said, they WANT to do it, but are FORBIDDEN by law because of thas Sony case :(

ok welll i finished talking with them again and they basically told me the same thing, and to look into trading standards uk which is what ive done. They said that they havent been sued by sony, and sony wouldnt sue them for refunding the psp, but he will get his supervisor to call me in the next 48 hours. he said that it sounded basically like a cop out, and i agree totally. (information for people having the same problem as me, he advised to contact your citizen beauro)

thats not true at all. i have proof about them having to uphold their guarentee, but no where does it say they cant give me a refund for faulty goods, which is what "1. Through UK law, they have to guarantee their warranty." this is saying.

Re-read it. This is a special rule in place because of the Sony case.

Looking at the Sales of Goods Act it only refers to the manufacturer. It only refers to the retailer once

In some circumstances, the retailer may be liable for any statement made by the manufacturer about the good

Do you have the exact wording on gbax's guarantee?
 
As I understand it the sticking Square button is a result of not enough plastic being trimmed off the edge of the button. It's not faulty design, it is however faulty manufacturing.

Is it possibly to ask sony to repair/replace your system without mentioning where it was purchased from or at the very least claiming someplace else? If You dont mention it was imported they might simply replace it with a unit from your own region (assuming it's not region 2), all you loose is the UMD movie playback (and unfortunatly very likly homebrew support but chances of them upgrading your firmware were high even if all they did was repair it).
 
I asked about that alpha2, but they said i needed to have a manufactures warranty with it. :(

infact they didnt even send me precise details about the guarentee, all i know is i have a recipet, and on their site when i bought the psp it said "ONE YEAR GUARENTEE" in bold green... pfft, learnt my lesson not to by from them anymore, cant trust them..

im just not going to bother now its too much effort, just gonna give it to my little brother and save up for another. Gbax could easily refund me my money/pay for repair, as any decent moral company would do, but gbax are basically lying thieves. especially the woman who answers the phones, and who reads the emails..because of their lying about dead pixel sales, their incompetence when shipping my order and friends orders missing out adapters and wipers etc...they dont reply to emails which ask for support, illegally importing a console and then not sticking with their guarentee.....would you buy from them again, i hope not . :/

No they can't!

By Sony successfully sueing ALL importers they aren't even allowed to acknowledge that they ever sold a PSP.
 
well Sony phoned me and said that if enough people had the same problem, they would write a letter to gbax to clarify the situation, so far i only know of me and a friend who have a sticky square button jap psp from gbax.com who want a refund (and deserve i might add)...anyone else?
 
Well, I wish Sony Good Luck in going against a company they already smashed dead...

They shouldn't be deciding based on what benefit they will get, they should be deciding because its morally and LEGALLY the right thing to do.

I don't know UK laws, but i'm sure that in the US they would still have to replace faulty units under their warranty even if sony sued them and they can't talk about it. If legally gbax isn't allowed to replace units under their GUARENTEE, then the legal system is totally fucked up (well, allowing sony to sue for that is fucked up, so I guess it already is :p ).

If Sony really have told you to return it then I don't think they have spoken to SJ Berwin (their legal people), but anyway, I have PM'ed you the address, please return it.

If you actually check your receipts, you'll find out that you did NOT buy it from GBAX, you bought it directly from a company in HK, and as such your contract is with them, not GBAX, and not Sony. GBAX didn't even have your credit card number.

So, legally speaking, it's got nothing to do with GBAX whatsoever... Its to do with the company you bought it from (SuccessHK, which were linked from gbax's website...).

EDIT: Unless of course you bought it and it was delivered directly from GBAX before they got involved with SuccessHK, then it's another matter entirely.

Just go to a store buy a PSP, switch it with the dodgy unit and then return it for a refund :eek:

Errm... would only work if Sony was REALLY stupid, as the PSP has model numbers on it ;)
