theoretically far more interesting (in my opinion) is the "you can download a recompiled version of your xbox360 game if the publisher allows it" news

I have no real clue, but my guess is that they need the publishers blessing as they need to do a partial or full recompile of the games source to make that happen. If they would just have implemented an emulation layer (no insights, but I guess most of the code is hardware independent with games calling API functions from the xbox360 SDK most of the time) they would not have any need to involve publishers.

Escapism episode: some time in the rather far future someone starts a xbox-wine project, reimplenting the xbone SDK API functions

Yeah, providing they have an Xbox 360 API implementation for the XBONE, then the publisher could recompile the source code and it should work. Of course, it will be loads more work than that, they effectively have to repackage the game, art assets and code, plus probably some endian-ness issues to sort out. Plus re-testing and re-certifying it for release. A fairly big job.

For massive titles, it might be worth a publisher doing it so it comes as a freebie with a new installment of a large franchise (some kind of "ultimate collection" edition), like Halo. This initiative was probably borne out of the work they did to get get the Halo collection and Anniversary editions working.
 
I'm betting that there is an additional motive.  

Clearly they are going to have new binaries of the old games sitting on the server that are piped back to the consoles.  The end customer having the old disc would simply be an ownership check for the game that gets downloaded.

If they can convince the title's owner to re-compile to the platform, then it can also be sold directly to others as an online purchase.

I suspect they're real motivation is to get old titles to the new platform to also act as the store to sell additional copies - which is hard to market if their existing customers with existing copies of the same game can't play without re-purchasing them.

Having the whole (or at least most of the) xbox360 lineup ready to download will surely boost their sales figures and attractivenes of the plattform.

Of course, though, only IP's that are still in license or wholly owned by the publisher, can have consent given. Anything that has a story/character/universe from some other IP owner (any of the superhero games for example, or crossovers like MvC) will probably not happen.

Trying to think of a non-superhero/game of the film title that has cross over or other IP in it. Can't think of one.
 
Great to hear that the Xbone is getting XB360 backwards compatability & mods, but won't mods potentially offer a route in for hackers? I appreciate they will go through certification & be locked down tighter than a very tightly locked down thing but the folk that do this kind of thing are pretty darn resourceful & it seems a bit silly to me to offer up potential options where none existed before.
