Some guy selling GP32 DVDs on ebay. You probably all know already.

I'd quite like to get him taken off ebay because I'd rather he didn't profit off people's hard work (at the moment one of the DVDs is going for £10 plus postage)... so if my game is on there I could complain and get him barred.

Anyone know what's on it? :)

I'm sure if several people said, "he never contacted me about it" (he claims he did) then he'd get barred. What a dick.

what a scumbag! maybe craig could shed some light as Doom would definately be his work.

and how can he justify putting Half-life on there!!!

edit: and he's already sold some looking at his feedback items

We got those dicks each month or so on german ebay. I recently asked two of them for a complete listing of contents, and funny enough, they both sold some of my games (besides full movies for gpcinema, full romsets, lucasarts adventures and of course all the other homebrew games). I sent the last guy a mail telling him to shut down the auction because he's selling copyrighted stuff (yes, even though homebrewn games are downloadable for free on the internet doesn't mean you're allowed to sell it - you're still tied to the authors license). He never answered, but the auction is gone. I don't know if he ended it or some other fella told ebay about it. Usually, ebay is rather fast with killing auctions, so it's worth a try.

i say we set up a fake account and boycott his auctions by asking questions at the bottom of the page and say sumthing like " DONT BID THIS STUFF IS COPYWRITED AND CAN BE DOWNOADED FOR FREE" . sumthing like that maybe?

or... gp32x puts together its own official dvd with games and apps with creator approval and uses the proceeds from said dvd to donate to creators of quality apps that still need polishing like osnes9gp

i msg'ed that guy to get a exactly list of the dvd content and acted like i would be interested. if "gianas return" is on it and "xump" i can go to my lawyer and bring this ass down, as he is obvisously acting like he sells it in a commercial way whic is prohibited and explicitly mentioned at least for those 2 games. i don't know if others have a sidenote like "commercial use prohibited" in their games. let's see if he is so dumb and sents a list.... then the action can start immediatly

How much does it cost to hire a lawyer in Austria who sues a guy in Germany for selling a CD on eBay?

I think the fact that the listing is completely in capitals is quite telling.

if anybody is desparate I'm sure we could band together and burn an ultimate GP32 dvd for someone.

just for the price of shipping and the media.

if such a DVD was required, what would we put on it (hinting for suggestions)

I would want such a dvd, IF all the authors agree on putting their stuff on it.
Maybe a some $$ for the gp32x board

That's what I'm actually planning for sometime next year... contact all the authors of the stuff in the GP32x File Archive, ask them for their permission and create a CD/DVD with all the categorized GP32 stuff on.
It won't be expensive, but every cent I get out of this will be donated to all the developers who have games on the CD.
I think I'll have the time to start that around March / April 2005.

It shouldnt be hard to get his details, although someone would need to stump up a tenner and pay by paypal to get them. Taking legal action will cost you alot in legal fees, my brothers missus is a trainee lawyer so I could ask her and see what she says.

In my opinion the best way would be for everyone to contact ebay and explain the situation and see if they can get the person to stop selling them.

I dont mind my stuff being distributed but not when its made for a profit, I have put a note about this in some of my games. If it was being sold for say £3 to cover expenses that would be fine, but £10 is clearly being sold for profit.

it made me laugh, he said he doesn't profit from p&p (or words to the effect) but he's charging £3 for it WTF?!

anyways, I've bought one - for several reasons:

1) to leave neg cost his lies
2) cos I can't be ar$ed to d'l everything myself & I might miss the odd thing
3) cos I intend to resell on eBay @ pretty much cost (prolly around £3-£5 inc) just to stop him! :p

what do you think?

any other ideas?

Sad :( ... but i think nobody plans buying a copy. Every GP32 owner knows about sites where download games and utilities for free like gp32x.de, gp32spain.com, and others.
Anyway, in every game made by me i put a text which clearly says in english and spanish: "This game is free, if you paid for it you were cheated". I think dev'ers must put in their games as well.

I'd say: let some graphically talented person (Antiriad maybe? :D ) create some banner for developer's homepages that says something like "Don't sell my stuff" or something. Even though this guy should _know_ that you can't sell other people's work they give away for free, it's only fair to mention you don't want that on your homepage. This way, nobody can say "I didn't know this!". Also, file archives should mention that in newsposts/frontpages, whatever.

That sounds like a GREAT idea! That more than likely would put this idiot in his place!

funny statement from the ebay auction posted on Dec 16 2004 at 8:36 AM said:
>ALL TOTALLY LEGAL!!
>NOTE TO EBAY THIS IS FULLY LEGAL DO NOT REMOVE

HEHE! Something seems amiss since he has 2 disclaimers about how it's 'LEGAL'...

You should buy one, then put the archive up for FREE DOWNLOAD! Put him right out of business!
