Well, there's one difference:
He doesn't sell the CD commercially and most probably didn't even create the collection - he just sells one CD he has (and most probably got from GBAX).
You may sell everything you own - if it's no illegal stuff like warez.
It's perfectly legal to sell a GBAX CD. If any authors do complain about being on this CD, they can complain at GBAX, the producer of the CD, but not a private person who resells it.
It's even legal to create your own CDs downloaded stuff from the Internet (if it's freely available for legal download, of course, and if the author doesn't FORBID it to distribute it on CD!) and sell it - with one exception:
You are NOT allowed to make MONEY from the free stuff - you may only charge the costs you had for creating and distributing the CD.
