Either he removed the roms or I am blind.
I just see that he tries to sell a CD with GP32 emus and software on which is perfectly legal.

Some feedback he got from selling that software ^^^^ -

E-BAY BOOTLEGER!!!!! AND A LIER !!! HE STOLE $70

In my opinion, you shouldnt be allowed to make money on the software that people had worked hard on and distributed to everyone for free in the first place.. If he was giving it away and just charging 50p for postage then it would be ok :p

Also how is it legal to sell GP32 software? Not all software is public domain/GPL... a few authors might be pissed about this.

This kind of thing reminds me of my respect for groups like tombstones. But unfortuntely, because of it's nature, it'll always be a bit 'underground' so scammers like this will still continue. I mean, I could stick a few 'fake' ebay items on, with just a message warning buyers to avoid and instead look up tombstones. But then, I'd probably just end up giving tombstones negative attention.

Whatyagonnado?

He, no, I just didn't know, you meant different items, I thought he offers it altogether.
Well, I just reported him for the SNES, GBA and PC Warez stuff.

Well, there's one difference:
He doesn't sell the CD commercially and most probably didn't even create the collection - he just sells one CD he has (and most probably got from GBAX).

You may sell everything you own - if it's no illegal stuff like warez.

It's perfectly legal to sell a GBAX CD. If any authors do complain about being on this CD, they can complain at GBAX, the producer of the CD, but not a private person who resells it.

It's even legal to create your own CDs downloaded stuff from the Internet (if it's freely available for legal download, of course, and if the author doesn't FORBID it to distribute it on CD!) and sell it - with one exception:
You are NOT allowed to make MONEY from the free stuff - you may only charge the costs you had for creating and distributing the CD.

I thought that was more of just a moral standing than a legal one.

[edit]...I suppose that's just where copyrighted stuff is concerned.

Yeah, it's because you basically offer a service.
If anyone can download it legally for free, you can do this for someone else and charge the costs you have.

You don't sell the software, but your service.

Hello,

Thank you for alerting us to the items you mentioned.

Let me first apologise for the length of time it has taken to get back
to you. Sometimes the volume of e-mail we receive means that we don't
get back to you as quickly as we would like, and I appreciate your
patience!

We have received a previous report and the the listing by the seller in
question has been ended by eBay.
