I think the idea is not just how many there are, but also how many are willing to upgrade and how many want a refund, etc. This will allow Ed to develop a plan. Personal info in addition would streamline the following process possibly.
yes, but if they did things properly their limitation is likely to the assets of the company (Limited -Ltd). If they did not meet the legal definition it might be able to go further. The laws in different companies vary and it really is not my area of expertise.

Ed, To fulfill your plan to ship to both your and Criag's pre-orders, I would assume you really would need to know where to ship them and what needs shipped. That is unless you are just shipping to Craig.

small claims in the US does not take long. Assuming they have the same in the UK, it should not talk long either. But getting over there and figuring out how to file will likely cost more than the recovery
The same place the money to fill any pre-order. It has been stated that with the sale of a 1G pandora (not upgrade) they can use the proceeds to ship an original pre-order. I would assume this is done by using the profits to fund the pre-orders.
