Does the ydpg16 and ydpg17 come with any bios or roms preloaded? I would like to avoid any copyright infringement, and therefore wouldn't want to buy one if they have those things included. If I were to get one of these devices I would want to use them in non-infringing ways. So if someone could tell if they come with bios or roms preloaded that would be great, Thanks.

yep they do..

Is there another alternative Android gaming device for those who want to stay away from copyright infringement. No preloaded bios or roms. What about the JXD devices?

JXD devices containts several roms that come with their emulators if you use the official fw. But you can still install a new firmware (for example skelrom 1.5, a dedicated version of android 4) that won't contain any roms.
But regarding copyright infringement, the design of the JXD S5110 and S601/S602 is really close to Sony PSP and Sony Vita, so i guess that it won't fit your need even if it doesn't containt any roms.
