N-Gage game battle 2003

So you're a developer from Europe or North America? This is your chance to win big - REALLY big.

We at the democratic republic of Nokia game development are calling on all citizens (you, that is) to give us the brightest, shiniest, most action-packed, multiplayer-friendly new game ideas. We want your imagination. We want great characters, complex plots, and game worlds decorated with the best visuals mobile gaming has ever seen. What are we offering in return? Cold, hard cash, plus the chance to develop your game for the N-Gage™ game deck!

It has to be an original title, exclusive to the Nokia N-Gage game deck
- Maximize mobile gaming over GPRS and Bluetooth, with wicked social and interactive features
- Think more co-operative and constructive, less blowing stuff up
- Use the N-Gage Arena to its fullest. Players will be able to download and play against ghosts, upload clips and high scores, get cheats and walkthroughs, share experiences, and meet friends.


By January 31st, 2004, send us:

1. A game demo based on the Symbian Series 60 platform and optimised for the Nokia N-Gage game deck
2. A document containing your concept, features, and other info
3. 6 screen shots

Then sit down, take a deep breath, and try not to let the endless minutes and hours of waiting get to you.

After January 31, 2004, a jury from the Nokia N-Gage Publishing team will sign away 30,000 euros, divided like this:

First prize: 15,000 euros
Second prize: 10,000 euros
Third prize: 5,000 euros

The top 3 winners will also go to the US Game Developers Conference in 2004.

I liked the bit that said "exclusive to the Nokia N-Gage ", wow, open source is not dead!!!!

Well, basically, what nokia are trying to do is to con you into making a game of the n-gage, in return for money. Sadly, they then own all the rights to the game, and if successful, they will tell you to fuck off, market the hell out of it and make lots of money.

As an independent developer, rule #1 in the rules eliminates us from participating:

The competition is designated to companies ("Developer") registered in Nokia prior to the end of the contest period and that have their registered place of business in the following countries: EU countries, Poland, Russia, Czech Republic, Hungary, Turkey, Bulgaria, Romania, Estonia, Croatia, Iceland, Latvia, Lithuania, Serbia, Slovakia, Slovenia, Ukraine, Switzerland, Andorra, and Canada and the United States of America.

Now for the killer, rule #13: (Swiss_Cheeseman is right on the money with this)

All right, title, and interest in and to all copyrights, patents, and other intellectual property rights of whatever nature arising out of or related to any game idea submitted to Nokia shall vest in, and be the sole and exclusive property of Nokia, whether or not specifically recognized or perfected under applicable law. Furthermore, the Developer agrees not to engage in any acts that might jeopardize, or contest or attempt to acquire, any rights of Nokia in or to the game idea submitted to Nokia, and shall upon request without cost to Nokia promptly execute all such documents as may be necessary to effectuate the vesting in, or transfer to, Nokia of such rights. The Developer shall assign and cause its employees and authorized subcontractors to assign any and all such rights to Nokia and take such additional actions as may be requested by Nokia to perfect any rights of Nokia thereto.
If and to the extent it is impossible as a matter of law to transfer ownership in any intellectual property rights or any part thereof from Developer, or Developer's employees or subcontractors, to Nokia, the Developer hereby grants to Nokia, and warrants and will take all necessary steps to ensure that its employees and subcontractors will also grant to Nokia, an exclusive, fully paid up, unlimited, irrevocable, perpetual, and worldwide license to use, modify, distribute and exploit in all possible ways, including the right to sublicense, any and all intellectual property rights relating to the game ideas submitted to Nokia.

Nokia will also own all rights in any copies, translations, modifications, adaptations, or derivatives of any development or game ideas, including any improvements or developments thereof. For the avoidance of doubt, the parties hereby affirm that Nokia shall have the sole right to copy, distribute, amend, modify, develop, sublicense, sell, transfer and assign the game ideas, associated documentation, or any enhancements thereof.

Nothing in these Rules shall be interpreted as granting to the Developer any rights in or to the development or any license to copy, adapt or take any other action in respect of same, all of which intellectual property rights are, by a these Rules or otherwise, vested in and the sole and exclusive property of Nokia.

Nokia retains the right not to enter into any agreements with the Developer to the contest.

Quite a long rule, eh? Basically you give them everything, and if you design a patentable method for your game, they own that too. And this even takes place IF YOU DON'T WIN!!! They have the right to take your idea and produce, develop, sell, even prevent YOU from using it someplace else. That's quite a big risk for only 3 winners out of a potential handful or more. ANY contest that tries to take your rights from your work, especially when the odds of getting nothing for it goes up as more entries are submitted, is a big red flag for me, and should be for everyone else too. That's why the prize monies are so high, because they know it!

I'm also not quite sure this rule holds much merit, but I'm surely not taking a chance if I was a company.
