Wares Did He Get These From I Wonder?


I got one of MRGP32 dvds out of interest and it did contain SNES / Mame roms and other illegal looking gp32 software, as well as lots of useless crap ;)

Actually, I've read the ebay Terms and Conditions, and he's breaking Ebay rules.

serously though: I don't think it's the most evil thing you could do. I would be happy to get a CD/DVD with all stuff on it, if I weren't sitting on DSL.

As some people say people still on 56k its great. Hes stated that these are free etc so whats the problem ?

So hypocritical when each one of us has a GP32 with illegal roms, perhaps some illegal mp3's or movies as well.

I've got tons of roms on mine so i cant talk but i'm not a hypocrite and moaning about someone selling this cd.

Bit like someone doing 100mph on the motorway and beeping their horn because they see someone on their mobile phone whilst driving. Double standards !

I think we had this discussion plenty of times. I don't want my stuff sold by other people. If there's someone who should make any profits off of it, it should be me. And I choose to offer my stuff for free on my homepage, which doesn't mean it's public domain and can be sold by anyone. You should at least ask the developers. A comparison between roms and homebrewn stuff just doesn't fit.

The sad part is if you actually did want to make a difference you'd have to invest lots of money into a lengthy and complicated legal case.

I dont sell these roms for a profit though!

i wanna start sellin cd-roms aswell for about £1 on ebay buy it now product.

i'v already started making one but not filled up a cds worth. its hard work u know...
 
If the program is GPL you can sell it at a profit, and pretty much do whatever you like with it. Infact several GPL programs have a suggested retail price.

The thing which gets me on ebay is people with 10,000+ feedback not charging VAT - they must be way over the limit, I suspect the govenment will be cracking down on that soon...

That's what I"m saying... I doubt there is even one person here does not have some illegal stuff on their GP... it always bugs me when I see people pop up with posts like this getting all worked up because someone is selling 'wares'. Why do you even feel the need to make a thread about this here? What does it benefit you to post this? We all already know there are plenty of people selling plenty of stuff they maybe shouldn't be on Ebay. Even for a devver to say "hey if anyone should be making money on these apps it should be me".... no, because he isn't making money on your software. HE STATES RIGHT IN THE AUCTION THAT ALL THE PROGRAMS ON THE CD ARE FREEWARE He is charging for the SERVICE of downloading them all, and conveniently putting them all on one DVD for people who can't be bothered with doing it themselves, either because they don't have time/their connection is too slow, they don't know where to get the stuff (and maybe they can't be bothered to look), or are just lazy and would rather pay someone else to do it. I think he's offering a pretty good service, really, considering the large number of people out there who are still on 56k, this could really benefit a lot of people who have a GP.

But has he got permission to distribute this FREEWARE from the software authors, As some authors only like their software to be downloaded from certain locations. Some authors and sites do sometimes make money through their FREEWARE software via sponsored links and ad`s to cover hosting costs etc, which i think this guy and others like him are taking this away from them.

Has anyone ever thought of setting up a service of selling CDs/DVDs with all the latest apps etc on them. You could charge for the price of the media and the postage only. This way the community is kept alive and nobody makes any proffit!

Wouldn't this be a good step within the GP32 community to combatting the eBay frauds?

Oh cool, so let's sell warez, uh, I mean, let's charge people for the effort of downloading and burning a warez DVD!

People offering their stuff free-of-charge doesn't mean it is "freeware" or "public domain" or anything similar!

Anyone selling CDs/DVDs at no profit (or profit that goes to FSF or charity organizations) has my consent for adding my stuff. People who try to make a buck don't. And let's face it, this bloke wouldn't sell those DVDs if there wasn't a buck to be made. If there wasn't homebrew software, there wouldn't be a DVD to sell, get the point?

If so, then why aren't devvers sueing him?

If something is freeware, that is to say, it is freely available, anyone can go and get it free any time they choose, then I can't see how one person is wrong for offering the service of gathering a lot of freeware apps and putting them all on one DVD/CD for you to buy. I really don't see how that qualifies as warez at all. If you're a devver and it really bothers you that he's got your app included in his collection, than contact him and tell him to remove it. Or sue him. And for everyone else, stop wasting space by posting here every time you spot someone selling the stuff on ebay.

Now if he were putting commercial software on a disc and selling it, that'd be warez.... you aren't making any sense with your argument.

and again, I bring up psj3809's response... how can any of you say anything about anyone who's doing something like this, even if it WAS warez? How many of you really, truly don't have one single illegal rom or app on your computer? How many of you with a broadband connection haven't once thrown a few things onto a CD to give to a friend or two who were less fortunate in their choice of internet service? Oh, because there is no money involved in these kinds of things they are somehow okay then?

Not sure if he does or doesnt, it would be nice of him to ask BUT have any of us got permission for all the roms/mp3's we have on our GP32's ?!??! Again some people are so hypocritical !!!

Look at Spectrum games, Codemasters and Ultimate are two companies who dont allow their games to be distributed. Practically every single C64 or Spectrum roms cd on ebay will have these games on there. C64.com features Ultimate games but their games have been denied distribution etc.

Even if this guy hasnt asked for permission then so what ? None of the game rom sites have asked for permission (World of Spectrum have asked many companies actually) and we're all happy to download all the games.

Have you got permission for every mp3 or rom on your GP32 ? I mean come on the vast majority of us ALL here use a GP32 for emulation dont we ? Maybe some of those programmers from the 80's of old games would love some royalties as for all we know they might be out of work right now or poor. And heres us playing their games they worked on for months for free ? Total double standards.

If there are people out there who want to pay for these cd's then let them. Its like those 419 scams you get on email, you know the types (I HAVE $ 40 MILLION US DOLLARS .....), i hate these people and shut down a lot of these fake bank websites and email addresses but then again if people are stupid enough to fall for it then its their fault. Same for the cd's, if you cant find the software online then sod em, let em pay for it. For others its just easier to get it in one cd. Same with some companies who sell cd's full of roms (check out www.retro-arcade.com) . Much worse than some kid making a tiny bit of profit selling those on ebay.

The hypocrisy from some people here is laughable.

Probably the same people who moan about emulators and bugs etc but have never given any money to the creators and are quite happy for free to use their work. I've already donated once to Rlyeh and will do the same again after fMAME is released.

There are a few differences.

Normally, I'm against warez.
Every single game I play on PS2, DC, PSX, GC, GBA I own.

BUT I also play roms - mostly NES and older systems. Games which are REALLY hard to get (and IF I do see them, I buy them!)
So, I'm not against roms - only against warez of games still easily available.

But the major difference is: No one SELLS these roms.
And he SELLS the freeware, thus making money.

That's the thing I actually don't like: SELL this stuff!

Hey, I could charge you money for the GP32x File Archive instead of giving all that stuff away for free - but I wouldn't do it, as I don't like making money with unlicensed stuff.

The only problem is the money...

BTW: I'm going to contact kknd_cf soon, as I'm currently coding an Offline-Browser for the GP32x File Archive - would be neat on his CD as autorun...
Descriptions, Screenshots, nicely sorted and categorized, installed by one click... hmmmm :)

I may even offer an update function for this... connecting online and downloading new stuff, though I'm not really sure yet (a lot of bandwidth and no banner clicks if it goes through the program... let's see...)
 
I really don't get your points, people. Why should forget about my copyrights? Just because the rest of the gp32 scene has roms on their SMC?
I'm no hypocrit. I don't use emulators on the gp32 (I basically bought it for development, and I enjoy playing homebrew stuff), therefore i don't have roms. Yes, I download mp3s and movies, and that ain't even illegal in my country, even if the RIAA and the MPAA make you believe it. And the best part of it: I ain't selling it. So stop calling me a hypocrit.
I don't get you, you're basically depending on homebrew games and apps and yet you don't respect the developers wish to be asked prior to include their stuff to a CD that's being sold.
Why don't developers sue all the guys who put their stuff on their CDs? Isn't that obvious? We're not in the USA everywhere. Legal suits are expensive as hell in most countries, and you have to pay in advance, and you don't know if you'll see your money back. Even if it was that easy to sue someone, I wouldn't do it. I don't even ask ebay to remove the auction, hell, I'm no sheriff (I actually caught two guys selling a DVD containing my stuff among other developer's games on ebay.de). I'm just pissed that people who belong to a user scene that *DEPENDS* on homebrew authors (face it, what if homebrew authors would stop coding now? You wouldn't see a lot of commercial games).
A good example would be: download GTA1 and GTA2 from Rockstar. They released it for free. Then, burn 20 CDs with those 2 games and sell them for 10 pounds each on ebay. Guess how long it takes until their lawyers kick your ass.
